Operation Basis
Construction Law of the People’s Republic of China, Law of the People’s Republic of China on Tender and Bid, Regulations of Shanghai on Administration of Construction Market, Measures for Administration of Contracting and Development of Construction Projects in Shanghai, Trial Measures for Self Tendering of Construction Projects, Notice of the Municipal Government on Batch Forwarding of the Temporary Measures for Approval of Corporate Investment Projects in Shanghai, Temporary Measures for Filing of Corporate Investment Projects in Shanghai, Temporary Administration Measures for Approval of Foreign Invested Projects in Shanghai and Temporary Administration Measures for Approval of Overseas Invested Projects in Shanghai as formulated by the municipal development and reform commission, and other laws, regulations, rules and normative documents relating to buildings and building materials
Scope of Application
Construction projects with a total investment of not less than RMB1,000,000 in the district
Required Materials
1. Form for Filing of Report for Construction of Projects in Shanghai in duplicate; the form for filing is generated (building and building materials industries in Shanghai), each of which shall be printed on the front and back sides of A4 paper, affixing the official seal and legal person seal of the construction unit.
2. Business License for Legal Entity (duplicate), original and photocopy of organizational code certificate, and relevant certificates of the construction unit; for those that are not State-owned, relevant certificates shall be provided;
3. Original and photocopy of establishment of construction projects
4. Original and photocopy of receipt of account opening of the account dedicated for the projects
Requirements for opening of accounts: (1) name of unit: full name of construction unit; (2) nature of funds: name of project designated in the establishment document; (3) nature of account: dedicated
5. Legal Representative’s letter of authorization (the handling person is entrusted to handle the report for construction)
6. Original and photocopy of the ID Card of the handling person
Projects that are distributed by means of tendering shall be conducted according to law. If the construction unit fails to entrust the tendering agency, but organizes tendering, it is required to submit:
1. Filing of Professional Technicians and Managerial Personnel of Construction Units in Shanghai in duplicate
2. Original and photocopy of technical title of professional technician and managerial staff
3. Original and photocopy of provident fund and retirement pension of professional technician and managerial staff
