To advance the facilitation of entry-exit goods clearance in China (Shanghai) Pilot Free Trade Zone (hereinafter referred to as the “Pilot Zone”), in accordance with the Customs Law of the People’s Republic of China and Notice of the State Council on Promulgation of the Framework Plan for China (Shanghai) Pilot Free Trade Zone (Guofa [2013] No.38), upon approval by the General Administration of Customs, matters about developing goods flow by “transportation under self-control” operation mode in the Pilot Zone are hereby announced as follows:
I. “Transportation under self-control” means enterprises registered with the Customs in the Pilot Zone (hereinafter referred to as the “enterprise in the Zone”) may use vehicles registered with the customs to conduct the operation mode of goods transportation under self-control.
II. Owners of vehicles conducting business of “transportation under self-control” shall complete the vehicles filing formalities with the competent customs at the places goods are transferred out of and into, and make the following submissions:
1. China (Shanghai) Pilot Free Trade Zone “Transportation under Self-control” Vehicles Information Filing Form (see Annex);
2. The original and copy of the Motor-vehicle License issued by the public traffic management department.
The customs at the places goods are transferred out of and into shall complete the vehicles filing formalities within 3 working days. After being filed for the record once, the vehicles of “transportation under self-control” may be used continuously in the Pilot Zone.
III. Without the consent of the competent customs at the place goods are transferred out of, vehicles may not arbitrarily stop, load and unload or pool another cargo on the way of “transportation under self-control”.
IV. If enterprises in the Zone and owners of vehicles have either of the following cases, the customs shall suspend this business:
1. Goods involved in suspected smuggling or import-export IP tort are put on file for investigation and prosecution by the customs;
2. Suspension as required by the customs for other illegalities.
After the investigation is finished, whether or not to restore the business depends on the actual circumstances.
This announcement comes into force on May 1, 2014.
